Massachusetts Attorney General's Office - Notice of Non-Compliant and De-Activated Charitable Organizations

All public charities operate for the benefit of the public they serve.  When operating or doing business in Massachusetts, they are required by law both to register with the Attorney General's Non-Profit Organizations/Public Charities Division (
M.G.L. c. 12, s. 8E) and to thereafter file annual reports with the Division (M.G.L. c. 12, s. 8F).  Moreover, individuals and organizations seeking charitable solicitations or engaging in fund raising efforts, are required by law to obtain a certificate of solicitation from the Division and to report the results of their efforts to the Division (M.G.L. c. 68, s. 19 ).  These registrations, filings and reports are available to the public and are intended to increase the public’s awareness and knowledge of the organizations which serve them and which may seek contributions from them.

Attorney General's Statement On Admission By Website That It Raised Funds Without Permission

"The organizer of an illegal business venture purportedly to raise contributions to benefit the family of murdered UConn football player Jasper Howard claims that it intends to go ahead with shipments of products supposedly sold for charity -- but has continued to fail to register this venture as required by law, or provide information that my office demanded about its unapproved efforts.
"Working with UConn officials, we will continue to carefully monitor this situation, and will take any and all necessary legal action.
"So-called good intentions do not trump the law -- particularly if the illegal activity continues. A public statement by the illegal fundraiser's 'organizer' acknowledges that UCONN declined to do business through the website.

Attorney General Distributes Settlement Money From Case Involving Misused Law Enforcement Charity Funds

Attorney General Richard Blumenthal today distributed the proceeds of a settlement involving alleged misuse of charitable scholarship funds by two New Haven police officers and a fraternal law enforcement organization.
The Boys & Girls Club of New Haven today will receive $23,000 that Blumenthal obtained earlier this year through a civil settlement with the New Haven County Silver Shields, a fraternal group for minority police officers, and two officers who once led the organization.
Blumenthal also alleged that Hunter and Ponteau filed false annual reports on behalf of the New Haven County Silver Shields for the years 1998 and 1999. New Haven County Silver Shields also failed to file any annual financial reports for the years 2000 through 2003, as required by state law.

Court Orders $15,000 Penalty Against Charity That Failed to File Financial Reports Since 1992

A Superior Court judge has ordered the Battle of Normandy Foundation to pay a $15,000 penalty to the state of Connecticut for failing to file annual reports about its financial activities since 1992.
Attorney General Richard Blumenthal and Consumer Protection Commissioner Mark A. Shiffrin said the charity is required to file annual reports under Connecticut's Charitable Solicitations Act.
"These reports are critical to our monitoring charities and determining whether donations are being used as donors intended," Blumenthal said. "Without this vital information, consumers do not have the information they need to make informed decisions about their charitable contributions."
"This judgment should serve as a clear message to all charities that their reports must be current," Shiffrin said. "These reports are the essential tools we need to ensure accountability for the charities."
The Battle of Normandy Foundation is located in Burtonsville, Maryland. The state's action against the foundation focused on the organization's failure to file annual reports for the 1993, 1994 and 1995 calendar years. The report for the 1996 calendar year is due May 31.
According to the 1992 report filed by the foundation, it raised some $1.7 million in that year and listed as its primary focus the education of the American public about the Battle of Normandy. Hartford Superior Court Judge Julia L. Aurigemma issued the decision against the foundation.
Blumenthal and Shiffrin said the state files about 10 lawsuits per year for failing to file reports, a step taken after repeated, unsuccessful attempts to get the charitable organizations to file reports as required by law. About 2,900 organizations are required to file the reports.

No Longer Accepting Paper Filings

State of Rhode Island - Department of Business Regulations is No Longer Accepting any Paper Filings for Registration of Charities Effective April 1, 2008, we will require all Charitable Organization, Professional Fundraiser, Professional Solicitor, and Fundraising Council applications and ALL associated documents be submitted on CD-ROM no later than thirty (30) days prior to the expiration date of your organization’s registration.
